All traffic/criminal cases are handled by this Department. Motions and pleadings filed in all traffic/criminal cases, pre-trial conferences, motion hearings and trials will be processed by this Department.
If you are ticketed or arrested within the jurisdiction of the Berea Municipal Court for a traffic violation or a city ordinance violation, your case will be processed in the Traffic/Criminal Department. Many traffic or criminal citations are waiverable, meaning that you can avoid a court appearance by pleading guilty and remitting the fine and court costs by mail, payment within the Payment Center of this site or in person. All waivers must be paid no later than the day prior to your scheduled court date. Certain citations require your appearance in court. This will be indicated on your citation. It is strongly suggested that when you are scheduled to appear in the Traffic Court that you bring your ticket, drivers license and proof of insurance to court.
Each municipality in the Courts jurisdiction is represented by a prosecutor. Prosecutors for the Berea Municipal Court do not have in-court offices, and generally cannot be reached by calling the Court. REQUEST FOR PRETRIAL DRIVING PRIVILEGES/RELEASE VEHICLE/APPEAL BMV ACTION
If you are requesting a Vehicle Release/Driving Privileges/Appeal action, the following steps must be completed:
1. A $55.00 filing fee for Occupational Driving Privileges must be filed with the Clerk’s Office. A $25.00 filing fee must be filed with the Clerk’s Office for any modification of driving privileges.
2. Request a two page Driving Privilege form / Instruction Sheet from the Traffic Criminal Department. If you need privileges for anything other than employment, i.e. probation officer meetings, counseling/treatment, AA meetings, please include those also.
3. If you need privileges to drive a vehicle in connection with your job, you must submit a letter signed by the employer stating employer’s request for your driving privileges, which acknowledges your offense.
4. For driving privileges, proof of current insurance must be attached showing you are covered from the date you submit your request throughout the period you will have privileges. You must also provide proof you were insured at the time of the offense.
5. When all the preceding steps have been complied with, please submit all required information and the completed page two of the completed Driving Privilege form, along with the $55.00 fee and proof of insurance to the Clerk’s office. You will then be scheduled for the next available Monday 10 AM session for ruling on your request by the Magistrate.
6. If your request is at the time of conviction or post-conviction, all fines and costs must be paid in full.
7. If the $55.00 filing fee has not been paid and/or your fine and costs have not been paid, you must go to the Clerk’s Office to pay the filing fee and all court costs before the Journal Entry granting you privileges will be released to you.
