The defendant appeared in open court and was advised of the nature of the charge, possible penalties, right to counsel, right to jury/court trial, other rights and the various pleas available.The defendant thereafter entered a plea of NO CONTEST to the charge. The court entered a finding of GUILTY to the charge.It is ORDERED, ADJUDGED, AND DECREED that the defendant is found GUILTY of DUI ALCOHOL AND OR DRUGSORC/CO 4511.19A1a, and is sentenced as follows:1) A fine of $400.00 plus all costs 2) Operator's license SUSPENSION of 365 days beginning on 08/15/2019 and ending on 08/14/2020. . Limited privileges granted on 05/11/2020 conditioned upon issuance of permit by court 3) A jail sentence of 8 Day(s) to be scheduled by the Traffic/Probation office. Jail time consecutive with other case(s) sentenced.4) Defendant shall be placed on Basic 1 Yr Probation.
5) In lieu of 3 days jail, defendant may complete the 72 hr Driver's Intervention Program (DIP) and must then pursue any recommended course of treatment. If 72 hr DIP not selected, defendant to complete 3 days jail and an Alcohol Assessment and all recommendations.
6) Court to allow defendant to perform house arrest at 3.6 days house arrest per 1 day jail
in lieu of the following number of days jail upon payment of all fines and court costs: 5 day(s).
7) Defendant to complete 40 hours of Community Service Work.
8) Complete the following amount of MADD meetings, not duplicating the tiers: 1 MADD meetings.
9) Complete the following Assessment(s) and follow all recommendations: Substance Abuse assessment(s).
10) To remain a law abiding citizen, with no further Criminal or Traffic Offenses.
11) Follow all rules and regulations of Probation. All Probation Conditions set forth are to run concurrent with the charges sentenced on this date.
12) Comply/complete all programs/treatment ordered by Probation Officer.
13) You are ordered to take and pass random drug and/or alcohol testing as ordered by your Probation Officer. The tests will be at your expense.
14) Defendant advised that failure to comply with any and all conditions of Probation will result in the imposition of the maximum penalties allowed under the charge of which defendant was convicted.
